Can immigrants get ACA Marketplace coverage?

Lawfully present immigrants can buy a Marketplace plan and, if their income qualifies, receive the Premium Tax Credit; U.S. citizens, U.S. nationals, and lawfully present immigrants are eligible to use HealthCare.gov, but undocumented immigrants are not, per HealthCare.gov (2026).

What the government has said, on the record

Here's how a federal official described it, on the record:

In order to be eligible, one has to be either a citizen of the United States or lawfully present.

Kevin Counihan, Chief Executive Officer of the Health Insurance Marketplace, Centers for Medicare & Medicaid Services, House Committee on Oversight and Government Reform, Subcommittee on Health Care, Benefits, and Administrative Rules, 2015-02-26 (source)

Editor's note: From 2015 testimony by the Marketplace's Chief Executive Officer. The core rule is unchanged: to enroll in Marketplace coverage you must be a U.S. citizen, U.S. national, or lawfully present immigrant. Eligibility details and any subsidy rules can change — confirm current requirements on HealthCare.gov.
